Final paycheck deadline in Hawaii

Hawaii law (HRS section 388-3) sets different deadlines depending on whether the employer ended the job or the employee quit.

When is the final paycheck due if an employee is fired in Hawaii?

All earned wages are due in full at the time of discharge. If the discharge happens at a time and under conditions that prevent immediate payment, they are due no later than the next working day.

When is it due if the employee quits?

No later than the next regular payday. If the employee gave at least one pay period's notice of quitting, all wages earned are due at the time of quitting.

What if the employer and employee disagree about the amount?

Under HRS 388-5, the employer must still pay, on time and without conditions, the wages it agrees are owed. The employee keeps any other remedies for the rest.
