Final paycheck after leaving a job
There is no single national rule for when a final paycheck must be paid; that is mostly set by state law and can depend on whether you quit or were let go. Federal law (the FLSA) sets minimum wage and overtime rules that still apply to the final pay period.
When do I get my last paycheck?
It depends on your state. Check your state labor department. The U.S. Department of Labor publishes a table of state rules on how often wages must be paid.
Is unused vacation paid out?
Federal law does not require it. Some states and some employer policies do. Check your state labor office and your handbook.
What can I do if my final pay is late or short?
Ask the employer in writing first, keep pay stubs and time records, then contact your state labor office or the Wage and Hour Division.
